The department maintains a recovery fund to make payments of certain actual out of pocket damages sustained by borrowers caused by acts of licensed mortgage banker residential mortgage loan originators. A written application for reimbursement from the recovery fund must be filed with and investigated by the department prior to the payment of a claim. All written complaints will be discussed with the appropriate functional area employees of the business. The appropriate personnel will draft timely responses to consumers and/or regulators. Generally, the Corporate President will keep a central file of complaints and responses unless stated differently in this policy, and the board of directors will review new complaints and responses at a board meeting at least quarterly, but more typically in response to any submitted complaint within 1 month.

Eligibility: The $350 credit towards your mortgage is subject to full review of assets, income, and credit for loan approval. Not everyone will be eligible to receive this credit. The eligibility requirements will be determined by the mortgage lender or financial institution offering the credit. By participating in the mortgage application process, applicants agree to comply with all the terms and conditions established by the mortgage lender or financial institution. These terms may include but are not limited to income verification, credit checks, loan-to-value ratios, debt-to-income ratios, and other standard mortgage lending criteria.

ABSM’s Loyalty Program applies to future refinances of the same property by the same borrower subject to the conditions and contact requirements outlined below. The Loyalty Program is non-transferable and may not be applied to a Purchase Loan, a Home Equity Loan, a Personal Loan, or combined with other discounts or promotions. The Loyalty Program excludes any loans received by ABSM from a third party loan originator (e.g., wholesale or brokered transactions). Future refinancing is conditional on whether the program type or applicable state/federal laws contain “seasoning” restrictions that would make refinancing during a specific period legal. For example, waiting until after the 12th month may be required. For future refinances of the same property with ABSM, this offer may not be redeemed within 180 days of the Date Issued. Your loan approval for any future loan is not guaranteed. The appraised value of your home for the future loan is not guaranteed. In the event a full appraisal of your home is required, the property value at that time must be acceptable for the program and loan terms requested. The interest rate for the future loan is not guaranteed. You will have to qualify for the loan requested and will be quoted interest rates in effect at the time of your next loan. For loans meeting the above requirements and which are successfully closed, your appraisal fee will be reimbursed at the closing of the loan transaction and no lender fees will be charged. “Lender fees” do not include discount points associated with your loan transaction. “Appraisal fee” includes only the fee associated with the first appraisal on your loan transaction and does not include any ancillary appraisal fees that may be charged in connection with your loan transaction (e.g., second appraisal fee, appraisal re-inspection fee, appraisal recertification fee, etc.). This program is only available to applicants who closed their previous loan with ABSM and received the ” ABSM’s Loyalty Program” certificate. Future applicants must contact ABSM directly via the website: myabsm.com or via telephone 305-826-4500 to qualify for the Loyalty Program. Applying for a loan indirectly through a third party (e.g., LendingTree) makes the borrower ineligible for this program.
